18 U.S.C. § 2257 Compliance Statement

Overview

18 U.S.C. § 2257, 18 U.S.C. § 2257A, and 28 C.F.R. Part 75 (collectively, "Section 2257") require producers of visual depictions of actual or simulated sexually explicit conduct to maintain records regarding every individual depicted, including documentation sufficient to verify that all performers were at least eighteen (18) years of age at the time the visual depictions were created. This statement is issued by LuckyDuck LLC as the operator of the Deblur platform (deblur.me) in accordance with 28 C.F.R. §§ 75.6 and 75.8.

Compliance Statement

All persons who appear in any visual depiction of actual or simulated sexually explicit conduct on or distributed through Deblur were at least eighteen (18) years of age at the time the visual depiction was produced.

The records required by 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 for every such depiction are maintained by the individual content Creator who produced and uploaded the depiction, in that Creator's capacity as the primary producer within the meaning of 28 C.F.R. § 75.1(c)(1). Platform Status

Deblur is a technology platform that enables independent content Creators to sell pay-per-view photos and videos through payment links. Deblur does not produce, direct, commission, or otherwise create any of the content that appears on or is distributed through the Platform. All content is uploaded and distributed solely by independent Creators who use Deblur as a sales and delivery tool.

Each independent content Creator who uploads material to Deblur is the primary producer of that content within the meaning of 18 U.S.C. § 2257 and 28 C.F.R. § 75.1(c)(1). As the primary producer, each Creator is solely responsible for compliance with all applicable record-keeping requirements under 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75, including the obligation to collect, maintain, and make available for inspection documentation verifying the age and identity of every individual depicted in their content.

Deblur's Exemption

Deblur operates exclusively as a technology service provider. Deblur does not:

• Produce, film, photograph, direct, or commission any sexually explicit content
• Hire, employ, contract with, or otherwise engage any performers
• Exercise editorial control over the content uploaded by Creators
• Select, arrange, or curate content for distribution

Because Deblur does not produce any content, Deblur is exempt from the record-keeping requirements of 18 U.S.C. § 2257 as a non-producer under 28 C.F.R. § 75.1(c)(4). Deblur's role is limited to providing the technological infrastructure through which Creators independently distribute their own content.

In addition, any visual depictions displayed on or distributed through Deblur are exempt from the record-keeping requirements of Section 2257 where:

• they do not portray conduct as specifically listed in 18 U.S.C. § 2256(2)(A)(i) through (iv);
• they do not portray conduct as specifically listed in 18 U.S.C. § 2257A produced in whole or in part with digital or computer-manipulated images of an identifiable minor after March 18, 2009;
• they do not portray conduct listed in 18 U.S.C. § 2256(2)(A)(v) produced after March 18, 2009;
• the visual depictions were created prior to July 3, 1995 (and are therefore outside the scope of 28 C.F.R. Part 75); or
• LuckyDuck LLC does not act as a "producer" with respect to the dissemination of such exempt images as that term is defined in 28 C.F.R. § 75.1(c).

Creator Obligations

All Creators who use Deblur to distribute content depicting actual or simulated sexually explicit conduct are required to:

• Maintain complete and accurate records in compliance with 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 for every individual depicted in their content;
• Verify that all depicted individuals were at least eighteen (18) years of age at the time the content was created;
• Retain copies of valid government-issued photo identification for all depicted individuals;
• Retain a signed depicted-person consent record as set out in our Depicted Person Consent Agreement;
• Make such records available for inspection as required by law;
• Comply with all applicable federal, state, and local laws regarding the production and distribution of adult content.

By uploading content to Deblur, each Creator represents and warrants that they have obtained and maintain all records required by 18 U.S.C. §§ 2257 and 2257A and that all individuals depicted in their content are at least eighteen (18) years of age.

Identity Verification

Deblur requires all Creators to complete a comprehensive identity verification (KYC) process before they are permitted to sell content through the Platform. This verification process confirms the Creator's legal identity and age through government-issued identification and a biometric liveness check performed by our identity verification provider, and is described further in our Privacy Policy (§§ 3.3–3.4). Creators who fail to complete identity verification, or whose verification is rejected, are prohibited from uploading or distributing content through Deblur.

Zero Tolerance Policy

Deblur maintains an absolute zero-tolerance policy regarding content involving minors. Any content that depicts, or appears to depict, individuals under the age of eighteen (18) is strictly prohibited. Deblur will immediately remove any such content, permanently terminate the offending Creator's account, and report the matter to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and appropriate law-enforcement authorities in accordance with our Complaints Policy.

Users who encounter any content they believe may involve a minor are urged to report it immediately to support@deblur.me.

Custodian of Records

As stated above, LuckyDuck LLC / Deblur is not the producer of any content distributed through the Platform and therefore is not required under 28 C.F.R. Part 75 to maintain Section 2257 records as a primary producer. The custodian of records for any specific depiction available through Deblur is the individual Creator who produced and uploaded that depiction.
