Third-Party Consent Agreement

If you create, upload, or sell content that features a real person other than yourself, you need documented proof that the person consented and is of legal age. This page explains what documentation you need, how to submit it, and provides a consent form template you can use.

This is not optional. It is your primary legal defense if a depicted person ever disputes their involvement in your content. Without it, you are exposed. With it, you are protected.

Required Documentation

For each depicted person, you must collect and retain the following before the content can be sold through the Platform:

  1. Government-issued photo ID — A clear, legible copy of a valid government-issued identification document (passport, driver's license, national ID card) confirming the depicted person is at least 18 years of age. The ID must show the person's legal name, date of birth, and photograph.
  2. Signed consent form — A completed and signed consent form that meets the requirements described in the Consent Form Requirements section below. The form must be signed by the depicted person themselves, not by a representative or agent.
  3. Verification photograph — A photograph of the depicted person holding their government-issued ID next to their face. This confirms that the person submitting the ID is the same person depicted in the content.

Why We Require All Three

An ID alone proves someone is 18 but does not prove they consented. A consent form alone proves intent but does not verify identity. The verification photograph ties the person, the ID, and the consent together. All three are needed to create a defensible record under 18 U.S.C. § 2257 and to protect you if a depicted person later claims they did not participate or were not of legal age.

The consent form must include all of the following elements to be valid. You may use the template provided below or create your own, as long as it covers every element listed here.

  1. Identity of the depicted person — Full legal name as it appears on their government-issued ID.
  2. Identity of the Creator — Your full name or business name as the content creator.
  3. Description of the content — A clear description of the type of content being created and how it will be sold. This does not need to describe every frame or image, but must be specific enough that the depicted person understands what they are consenting to. Example: "sexually explicit photographs and video content for sale through Deblur payment links."
  4. Distribution scope — A statement that the content may be sold through the Deblur platform as pay-per-view content.
  5. Age confirmation — A statement by the depicted person confirming they are at least 18 years of age.
  6. Voluntary consent — A statement that consent is given freely, without coercion, duress, or deception, and that the depicted person understands the nature of the content.
  7. Right to withdraw — A statement that the depicted person may withdraw consent at any time by notifying the Creator in writing. See Withdrawal of Consent for what happens when consent is withdrawn.
  8. Compensation disclosure — Whether any compensation (monetary or otherwise) is being provided to the depicted person, and if so, what form it takes.
  9. Date and signature — The date the form was signed and the depicted person's handwritten or qualified electronic signature.
  10. Creator signature — The Creator's signature and date, acknowledging receipt of the consent form and ID verification.

How to Submit Documentation

Submit depicted person documentation through the Deblur platform's depicted person documentation system. You can access this through your Creator dashboard under the content compliance section.

When you submit documentation, our team reviews it before the associated content is approved for sale. The review process typically takes 24–48 hours. If there are issues with your submission, we will notify you with specific details about what needs to be corrected.

Do not distribute content featuring a depicted person until their documentation has been reviewed and approved. Content sold without approved documentation is a serious violation under our Content Policy.

Record Retention

You are required to retain all depicted person documentation for the longer of:

Deblur also retains a copy of all submitted documentation in accordance with our Privacy Policy and legal obligations. However, our copy does not replace your obligation to maintain your own records. You must be able to produce documentation upon request by Deblur or any authorized legal or regulatory body.

Withdrawal of Consent

A depicted person has the right to withdraw their consent at any time. When consent is withdrawn:

  1. The depicted person must notify the Creator in writing (email, message, or any verifiable written form).
  2. The Creator must cease distribution of all content featuring that person within 48 hours of receiving the withdrawal notice. This includes disabling any active payment links.
  3. The Creator must notify Deblur of the withdrawal through the platform so that we can flag the content in our systems.
  4. Content that has already been delivered to buyers who previously purchased it cannot be recalled, but must not be re-sold or redistributed.

Failure to stop selling content after a depicted person withdraws consent is treated as a serious violation under our Content Policy. The content is non-consensual from the moment consent is withdrawn, regardless of when it was originally created.

This Is Not Negotiable

Consent withdrawal is absolute. The depicted person does not need to give a reason, and the Creator has no right to dispute or delay it. The 48-hour window exists to give you time to identify and remove all affected content, not to decide whether to comply. If you cannot identify which content features a specific depicted person, you must err on the side of removing more rather than less.

Content with Multiple Depicted Persons

If your content features more than one depicted person, you need separate, independent documentation for each individual. Each person must sign their own consent form and provide their own ID verification. One person cannot sign on behalf of another.

If one depicted person in a multi-person piece of content withdraws consent, the entire piece of content must be removed from sale unless the withdrawing person can be fully removed without altering the remaining content in a way that misrepresents the remaining participants' consent.
